As Human Resources professionals, terminating an employee is never pleasant, but some terminations can cause you to lose extra sleep. You may worry whether it is the right decision, or whether anything else can be done to reduce your organization’s exposure. The termination may be high risk because the employee involved has a propensity toward violence, or because it subjects the company to potential exposure due to the employee’s recent complaint or medical leave. Terminations may be high risk or high exposure for a myriad of reasons. However, there are times when termination is still the right choice for your business. In those instances, you should feel like have you have tools to move forward, and not be frozen into inaction. This presentation will explore how to prepare for high risk terminations, tips for mitigating risk in these situations and how to effectuate these terminations.



Katharine Batista is an Employment and Labor Attorney at Offit Kurman, P.A., one of the fastest growing full-service firms in the U.S., who represents businesses in the spectrum of employment and labor claims. Ms. Batista successfully defends employers against claims of discrimination and harassment, retaliation, wrongful terminations and wage and hour violations. Ms. Batista also commonly represents her clients in actions for breach of restrictive covenants and contractual interference. In addition, Ms. Batista counsels companies on workforce issues and commonly presents and trains on employment law topics before local and state industry and human resources organizations.

Prior to joining Offit Kurman, Ms. Batista worked at Jackson Lewis, P.C., a national employment and labor law firm. During her tenure there, Ms. Batista completed a secondment as the only in-house employment and labor counsel at a global chemical, science and engineering company. Prior to joining private practice, Ms. Batista clerked at the Connecticut Appellate Court for the Honorable Richard A. Robinson, now Chief Justice of the Connecticut Supreme Court.

Ms. Batista currently serves on SEPA SHRM’s Board as the VP of Programming. In 2017-2019, Ms. Batista was selected by SuperLawyers to the Pennsylvania Rising Stars lists. She attended the University of Connecticut, where she graduated with honors, and Suffolk University Law School, where she graduated magna cum laude. Ms. Batista is admitted to practice in Pennsylvania, New Jersey, Massachusetts and Connecticut.
